BUYER BEWARE : Andrew Bishay aka M3joky8

I didn't want to have the situation come to this but it did.

Here's his info :

Andrew Bishay
sn : cameljoky8
DTM id : m3joky8

Andrew aka m3joky8 parts M3's. He's parted two out to my knowledge. At the beginning of August, he recieved a wrecked 98 silver M3 and he put parts up for sale. He put up a 3 spoke steering wheel and airbag for $350.00. I saw it as a great price, talked with him at which point he told me that many people were interested so the current bid was 425, i offered him 450 shipped and the deal was done. I sent him a cashier's check the next day ( i have a copy of this cashiers check). Next couple weeks went by and no steering wheel but I wasn't worried. I would talk to him every couple of days. He also has decent feedback on eBay. He told me he was having troubles taking the wheel off so I told him there was a write up on the internet (alan taur/frank henderson's). Sent him it and it seemed it was the missing link. Then i don't see him for 5 days, i start to wonder but still give him the benefit of the doubt. Finally he comes back and tells me sorry for the delay and his buddy got the wheel off. Im now at college so I tell him to send me the wheel there. We are now in the first week of September and I get the wheel. I wait a couple days before I go to put the wheel on. This is where the nightmare begins. The slipring is cracked, and is missing a plastic piece that protrudes out like a fin. Then comes the kicker. HE TOOK THE WHEEL OFF BY DRILLING THE SCREW HOLES OUT. Now for someone who is in the business of taking parts off, you would think he would use some common sense. Me and my friend got the wheel on my car by a miracle though , it took about 2 hrs just to mount the airbag cause there was little to no thread since the way he drilled it out put these huge circles (i am going to post pictures). After the wheel goes on, take a shower than go out for a ride and the wheel squeals like crazy and the turn signal doesnt turn off automatically when the steering wheel returns to its normal position. The reasons for this are cause the slipring is cracked and the lock support bracket (the 3rd part in this job) is what andrew says he gives me but it isn't (ill explain later). I contact Andrew via IM and the nightmare begins.

Here's the first conversation :

Zubin81: yo
Cameljoky8: whats up
Zubin81: me and my friend got it installed, even though it was an absolute bitch to do, i dont know if ur friend took the airbag off
Cameljoky8: huh?
Zubin81: but the screw holes were partially gone because he drilled holes
Zubin81: into the back
Cameljoky8: is it installed?
Cameljoky8: is it working?
Zubin81: even after getting one side of the airbag hooked up, we had to use glue hooking the torx bit to the torx screwdriver
Zubin81: ya
Zubin81: horn works and airbag lifht doesnt come on
Cameljoky8: huh?
Cameljoky8: horn lift?
Zubin81: sorry light
Cameljoky8: so it all works...
Zubin81: ya,
Cameljoky8: these wheels were not meant to taken off an changed
Cameljoky8: they are not easy to take off
Zubin81: unless it doesnt turn, because on the slipring, part of the thing was broken, like this fin part, but i think that's just a guide anyways
Zubin81: ya i know
Zubin81: but im sure ur more careful than anoyone else
Cameljoky8: no no thats the way it looks
Cameljoky8: it looked difffernt then the 4 spoke i have
Cameljoky8: for some reason
Cameljoky8: i thought the same thing
Zubin81: ya, but u can tell its broken off
Zubin81: if u look at the plastic
Zubin81: yo

--------------------------------------------------------------------------------
Auto response from Cameljoky8: Just getting out and doing stuff cuz i am bored....
--------------------------------------------------------------------------------

Zubin81: yo
Cameljoky8: whats up
Zubin81: the wheel is ****ed up dude, the piece that is missing
Cameljoky8: what?
Zubin81: controls the auto signal on and off
Cameljoky8: auto signal?
Zubin81: u know when u are making a turn in ur car
Zubin81: and u use ur turn signal
Cameljoky8: thats not part of the wheel
Cameljoky8: its called a turn signal stalk
Cameljoky8: completly seperate part
Cameljoky8: it runs on its own springs
Zubin81: the thing that hooks on to the steering wheel is the thing its hooked to
Cameljoky8: ok...
Zubin81: it detecs when the wheel turns
Cameljoky8: maybe you just didn't install it right
Zubin81: i installed it right dude, and it was a miracle me and my friend got it installed period
Cameljoky8: there is nothing wrong with that wheel
Zubin81: there is dude
Cameljoky8: except for the screws
Cameljoky8: that hold the airbag.
Cameljoky8: i will give you that
Zubin81: the slip pin ring was cracked first off
Zubin81: then the screw holes that are on the airbag were drilled
Cameljoky8: yes i said that....
Zubin81: i can take pictures if u want man, im not a hustler
Cameljoky8: neither am i
Cameljoky8: but you talkin about minute things
Zubin81: dude, i went out for a drive
Zubin81: and the thing squeaks like a mother ****er
Zubin81: cause the thing is cracked
Cameljoky8: what is cracked?
Zubin81: the slip ring
Cameljoky8: get a new one
Zubin81: a new one is like 120 dollars
Zubin81: and it will take a miracle to get the airbag back on
Zubin81: after i have to take it off
Cameljoky8: what do you want me to do?
Zubin81: i just want to send it back for a refund, i think thats fair
Cameljoky8: no thats not....
Cameljoky8: the bag is not majorly defected
Cameljoky8: you bought a used bag.....AS IS
Cameljoky8: and to add to it...i also included a highly costly part that needed to install
Zubin81: andrew, the bag is defected
Cameljoky8: you told me yourself that bag was a pain in the ass
Cameljoky8: to install
Cameljoky8: maybe you messed up on install
Zubin81: what part did u include
Zubin81: that was so expensive
Zubin81: the lock support bracket
Cameljoky8: yeah
Zubin81: that retails for 2.59 at any bmw dealership
Cameljoky8: well then....you seem to know prices pretty well
Zubin81: the airbag isnt a bitch to put on, its because somebody drilled
Zubin81: holes into it
Cameljoky8: you should also know what the wheel is worth
Zubin81: andrew, did u see the bag before it was sent out
Cameljoky8: yes
Cameljoky8: i packaged it
Zubin81: so u know what im talking about
Cameljoky8: i took the other bag off the same way
Cameljoky8: and the guy that bouught my other won....fixed the problem
Zubin81: how did he do that
Cameljoky8: i will find his email for you
Cameljoky8: and you ask him
Zubin81: ok, regardless though, what about the slip ring
Cameljoky8: but no offense your complainin about minute thigns
Zubin81: dude, drive my m3 right now
Cameljoky8: the slip ring was cracked when it left here
Cameljoky8: call fedex
Cameljoky8: and have them pay for a new one
Zubin81: i cant file a complaint, only the seller can
Cameljoky8: what?
Cameljoky8: i can't file a complaint on YOU can
Zubin81: i dont even have any details of the thing, aka tracking number, refence etc
Cameljoky8: cuz your receieved it
Cameljoky8: its on the box
Zubin81: u just said the slip ring was cracked when it left
Cameljoky8: no i didn't
Cameljoky8: i thought you mean the lower piece...
Zubin81: Cameljoky8: the slip ring was cracked when it left here
Cameljoky8: the kind of fin thing that was sticking out
Cameljoky8: i said it looked different
Zubin81: ya, that was broken
Zubin81: it supposed ot have one too
Cameljoky8: is it an actual part of the wheel....
Cameljoky8: NO its not
Zubin81: as is is one thing, doa is another man, u know i dont complain
Cameljoky8: doa?
Zubin81: i waited a month for it, and when other people would have bitched and complained, i was calm about it
Cameljoky8: yes and i sent you what you paid for
Cameljoky8: you said it yourself it works
Cameljoky8: the slip ring is the problem
Cameljoky8: you should have asked about the slip ring....
Zubin81: the slip ring comes hooked to the steering wheel
Zubin81: it is part of the wheel
Zubin81: that just the name of it
Zubin81: when u buy the steering wheel from bmw, u get that attached to it
Cameljoky8: i am going to the bmw dealer tomorrow
Zubin81: ok
Cameljoky8: let me see how much a slip ring is....
Zubin81: ok
Zubin81: im flying home to miami for the wknd
Cameljoky8: i'll do something to help you out
Cameljoky8: but return your money is out of the question sorry.....
Zubin81: so ill talk to u on sun night when i get back to boston
Cameljoky8: you fought for that wheel
Cameljoky8: REMMBER
Zubin81: i dont see how it is dude
Zubin81: ya, for something that worked
Cameljoky8: i dicked over alot of people cuz you wanted that wheels
Cameljoky8: it does
Zubin81: how did i dick over people
Zubin81: i offered u a price
Cameljoky8: I did
Zubin81: and u took it
Zubin81: thats the way commerce works
Cameljoky8: ok listen
Zubin81: if its such a hot commodity, why not take it back and resell it
Cameljoky8: cuz i don't have the time
Cameljoky8: if you noticed
Cameljoky8: i don't deal parts anymore
Cameljoky8: just liquidating what i have
Cameljoky8: listen....i will help you out the most of my ability
Cameljoky8: if you were to tell me.....
Cameljoky8: the bag does not fit or can not be installed then ok....i would return it immdedtiely.....
Cameljoky8: but you told me the slip ring is cracked
Cameljoky8: and that can be replaced
Cameljoky8: you bought it used from me stating AS-IS
Cameljoky8: if the slip ring was such a problem for you ..
Cameljoky8: you should have asked about it
Zubin81: andrew
Zubin81: i bought a steering wheel and airbag from u
Cameljoky8: ytes
Zubin81: i bought it to replace my 4 spoke
Cameljoky8: yes
Zubin81: right or wrong
Cameljoky8: yes
Cameljoky8: use your old slip ring?
Zubin81: im not honestly complaing about minute things
Zubin81: u cant, its attached to the steering wheel
Cameljoky8: but you just you can buy another one
Zubin81: and its different styles, cause they changed the way the horn works
Cameljoky8: listen let me go see how much i can get one for
Cameljoky8: and we'll go from there
Zubin81: ok
Cameljoky8: do you ahve a parts number?
Zubin81: 32 34 1 162 111 , that might be it
Zubin81: im not sure though
Cameljoky8: might be?
Cameljoky8: i need a parts number....
Zubin81: thats what the write up says , but thats for a euro wheel
Cameljoky8: find me the parts number and email
Cameljoky8: cuz you know the dealer is an ass unless you ahve the the number
Zubin81: ok fine
Cameljoky8: i'll work out something with you....but won't return you money to you.....because in my eyes its not a MAJOR defect
Cameljoky8: if you want to get all pissed off....then fine
Cameljoky8: but i am offering my help
Zubin81: andrew, the wheel doesnt work period, it is a big defect
Zubin81: i wish i could pick u up right now and take u for a ride
Cameljoky8: you just said.....it drives but squeals
Cameljoky8: and you said that is becuase of the slip ring
Cameljoky8: am i right?
Cameljoky8: now yoru saying it doesn't work at all
Zubin81: no, the signal doesnt work cause of the slip ring
Cameljoky8: ok.....
Zubin81: and it sqeuaks cause the slip ring is cracked
Cameljoky8: ok replace the slip ring.....
Cameljoky8: and then whats wrong with it?
Cameljoky8: i don't get it....
Zubin81: ya, replacing the ring will do it
Cameljoky8: ok.....then
Cameljoky8: your mixin up your stories man....

Zubin81: im not, the slip ring has caused two probs
Zubin81: ya, when i talked to u, i hadnt driven the car yet
Cameljoky8: come on....thats hard to bleive
Zubin81: i brought all the shit in my car back to my suite
Zubin81: then took a shower and went out again
Cameljoky8: i am sure you moved the car.....turned the wheel....to makes sure the thing was intalled right or osmething
Zubin81: after we finished the job, all i did was make sure the horn and the airbag lifht didnt come on
Zubin81: ya, i did move thewheel, and it was fine, but driving it was a whole nother thing

POINTS OF REFERENCE

- He told me to show him the pics after his exams were over that week. Well I never saw him again. That was nearly two fridays ago. I believe he is online but he has me on block and anyone not on his buddylist.

- He just got a 99 Estoril Blue M3. That's wonderful Andrew, I hope you feel good driving your new ride with my money.

- He takes aparts M3's yet he doesnt have a parts CD, that's pretty lame

- He says he dicked a lot of people to get me the wheel. Umm, i offered a price, he accepted, its called COMMERCE

- He tried to say he offered me a valuable piece neccesary to complete the job. He gave me the bolt that you use to put on the new wheel. I was under the impression it was the "lock support bracket" He told me that's what it was and I believed him. I figured hey, he's in the parts business he must know what he's talkign about. This is probably why my turn signal didn't work.

- Acusses the part of being valualble when it's worth 2.50

- Accuess me of not installing it right when I gave him the instruction on how to take it off and he ****ed thigns up uninstalling it

- Claims I should have asked about the slip ring, its not part of the wheel, come on now.

- Basically, the wheel was in mint condition on his wrecked car. He then wrecked it by taking it off, that simple. He then makes me weight a month and go through hell. I need to attend to his schedule when he has to realize he's dealing with a business here.

- When me and my buddy took of my steering wheel to put on the old 4 spoke, teh thread was permanently worn. WE got it on once by miracle, and you will clearly see from the pictures what im talkign about. Now im out the cost of a 3 spoke steering wheel.

I've spoken with this kid in the past. Why am I not surprised.

You stated:

Now for someone who is in the business of taking parts off, you would think he would use some common sense.

He's not in the business of salvaging bimmers. He's just a kid who conned his mom into letting him put a couple of wrecked cars in the garage.

.. my eyes are dead from reading that whole damn mess. Clearly it is his fault and you should be entitled to a full refund. He did not state to you that he "drilled the screws out" and that "there are no threads to attach the wheel to (not to mention that the slipring is broken)." You did do business with him even tho he is an amateur "salvager". I say its time to take action in your part. Get the box where the wheel was ship and get all of the information there... ie. his address?! Get some of your biggest friends and confront the kid. It would not be the shipping companys fault since they only transported it. Lol, or you can just tell his mom and hopefully she'll just pull his ear and make him give the $$ back. But on a serious note, take some action and go get things done. Good luck.

I think what you should have done is when you first received the steering wheels with those defects you stated, contact him right away to send it back...instead of putting it on your car. From this point on...since it was already installed on the car..it might be difficult to contact FedEx and claimed damage during shipping. Worth a try though. I hate dishonest seller...especially BMW owners that sell bad parts to other..what an abuse of trust!!

I noticed the defects when I was actually installing the wheel, when i got it, i looked at it but didn't notice the defects. It wasn't damaged by FedEx even though our boy Andrew suggested I take up a claim. Let's not try and ****over FedEx when they didn't do shit. Even If i did file a claim, FedEx would have come over here and taken one look and laughed at me based on the actual damage (since drilled out holes and the crack in the ring could never have been incurred during shipping).

You did do business with him even tho he is an amateur "salvager". Good luck.

My eyes are dead too!! But honestly, it is your fault, you should have asked about the slip ring Are you phucking kidding me!!!!!!!!! Dude, like Iwannadinanm3 said, get all the info on him that you can and take some sort of action. I'm not saying beat him up, thats stupid, but some how do something. Talking to his mom would be great!!

My eyes hurt too. Sorry for this unfortunate occurrence. I feel your frustration, I want to hit this guy! I never send checks to anyone no matter how sweet the deal is. Credit card only!
Although I can't help I can suggest that in the future when dealing with shady people, or in that matter, for anyone you don't know.... USE an Internet escrow service. Here is one that is used often.

http://www.escrow.com/_
Guiding Buyers and Sellers Safely Through the Online Escrow Process

How does it work?

1. Buyer and Seller Agree to Terms
Both parties agree to terms of the transaction, which includes a description of the merchandise, sale price, number of days for the Buyer's inspection, and any shipping information.

2. Buyer Pays Escrow.com
The Buyer submits a payment, selecting check, money order, wire transfer, or credit card online. Escrow.com verifies the payment. Processing time varies by payment method.

3. Seller Ships Merchandise
Upon payment verification, the Seller is authorized to ship merchandise and submit tracking information. Escrow.com verifies that the Buyer receives the shipment.

4. Buyer Accepts the Merchandise
The Buyer has a set number of days for an inspection and the option to accept or reject the merchandise. For more information, FAQs - Return Questions.

5. Escrow.com Pays the Seller
Escrow.com pays the Seller by check or wire transfer. The transaction is complete.

Good Luck!
