| yes, tickets can get thrown out for small technicalities even things such as the officer spelling your name wrong or putting down the wrong address(my brothers friends have gotten off on everything from speeding to dui's on these technicalities, but they were also wealthy with good lawyers), at least up here in WA, but im sure its the same or similar. the way i see it this is a larger technicality. |

| be careful with THE MAN. reguardless of the technicality, they can still screw you. if you want a sure way out. get a cheap laywer. If you use the system, the system will work for you. Hell, use one of those public attorneys - should work just fine |

| As always my advice is, "get a lawyer". It's better to get off the first time than to go back and appeal which costs you more money. I am no lawyer and this is not legal counsel. You should get off due to the technicality however make sure you don't incrimate yourself by saying, "I turned yadda yadda...". Thats why you have a lawyer so he/she can discredit the officer without being asked incriminating questions as I am sure you would be asked if you posed the discrepancy. Second, what time was it? How does the officer know what time it is? Is the timing device calibrated (his watch)? Is it certified? (air bears have to have calibrated timing systems, cops have calibrated (not!) speedos, laser guns and radar guns are also calibrated). His watch could have been off. Has he adjusted it since then? Does he adjust it to another clock at headquarters or against an atomic clock. NOTE that lots of cops have computers in their cars. The computers (some) download their time from a network device that may connect to a device giving out atomic time. Is this a certified process? Is certification required? The sign. Are there laws stating the city/state must have a backing bigger than the sign so it's readable even in backlight (like the stop lights have). Take a picture at 3:58pm from about where you sat and take it to court to show you cannot read the sign due to direct sunlight. Take multiple pictures a few feet apart, with different appetures. Do other intersections in the same city have the same or similar sighs but not on the stoplight area like this one? (ie on a pole in the median, or someplace where it is easier to read in the afternoon? If so you may use that in your argument but the problem is it speculates the reason the sign is there, if you had proof they moved that one due to sun, then you might sway the judge. Anyway, go in with as much as possible. IMHO the more credible data and evidence you have, the less likely the judge will want to spend the hour arguing for their $86 bucks (or whatever it is). It becomes too costly and that does have some weight. Note I my experience is from Washington traffic situations, not Cali. Cali is like it's own country sometimes.
