| The speed limit from from High Point Rd to Guilford College Road is 60, it then goes up to 65 from Guilford College road through the I/Bus split. Its not where he pulled you over, its where he clocked you. So if he was trailing you for 20 minutes, and your highest speed was 86, he recorded that place and speed limit. A sheriff won't usually be a hard as, but they can search the open parts of your car with probable cause. The can't open anything locked, or ask you to open anything locked without a warrant, so had you locked your car, they couldn't have searched it . That said, probable cause can include evasion, being a hard ass(seriously), or felony speeding, which you were. I am suprised you only recieved a ticket. I have two friends that have recieved Reckless and Endangerment through that area for those speeds. Cops are nice until you question their authority, and at that time they go on a crazy power trip. You might be able to get it thrown out with them searching, but it doesn't take much for them to be allowed search your car. On that searching note, at my school, they were doing drug searches/sniffs/whatever, and they were going around the cars. Well one of the dogs went crazy at my beater, and when they called me to the office, I knew my car used to be driven by a crazy user(thats why I got it so cheap). So I get to the office, and they let me go and say they didn't find anything, false alert. Well when I get out to my car, there was some stuff moved, so I know they went through it. After talking to an officer about it later, the dog was going crazy on my car, so they opened it and searched it. The dog proceeded to start chewing on some KY Jelly and some other female sexual pleasure items. The whole administration saw it/them. Made my year!

| ask mid-atlantic, since its the local forum for NC. so you said they couldnt search....no wonder they did. if you didnt have anything to hide, why did you care? No offense, but people really need to take some law classes.

| i have taken a few law classes...thats why i told them they couldnt search. They didnt find anything, I had nothing to find, but it pissed the fuck out of me that they searched when i told them not to. Good part was I was polite the whole time and i was talking to the other 3 fucking cops while the one who pulled me over searched me car and joking around with them. Single. Do you know what the speed limit is between exit 212 and 211...he clocked me in between them, I saw his car pulled over on the side of the road probably half a mile before exit 211. It was weird because as soon as I got back on the highway there was a 65 sign... EDIT: they also didnt ask me to search, they TOLD me they were going to search and I asked if they were allowed to. As he opened the car I told him that I didnt give him permission and that if they werent allowed to my answer was no. Last edited by AdrenalineRace : 11-27-2004 at 06:58 AM. |

| Hey man, i had a similar situation. I got pulled over with a bunch of my buddies in the car. The said we were going 72 on a 55, well they took us out of the car and sat us down in the curve. Next thing you know they ripped the panel out of the driver and passenger side of the Explorer i was in. They fucked up the car pretty much...went to court, and it got thrown out because they had no probable cause. My advise, go to court, represent yourself, and bring up the point that there was no probable. Or hope he/she dont show up.

| [quote=Rob ITR1035 so you said they couldnt search....no wonder they did. if you didnt have anything to hide, why did you care?QUOTE] its the principle of it. some poepl dont like a cop digging through their personal possesions without a probable cause. The fact that they wear a badge does not give them the right to violate a persons civil rights. |

| thats pretty much the reason i didnt want them going through my shit... i wanted to get back on the road, i had another two hours left in my drive. Im hoping this might be able to clear this ticket because I definitely told them no and he did it anyway. He said I was speeding, switched two lanes without a signal, and got off at an exit, so i was evading arrest. To me that doesnt sound like probable cause, ESPECIALLY since I told him I was getting off to get food and something to drink. You think I might be able to pull it off getting out of it because of this? EDIT: he broke my ashtray too, not too big of a deal but still broke it...pissed me off, and maybe that will help my cause haha Last edited by AdrenalineRace : 11-27-2004 at 09:22 PM. |

| in NC they dont throw out the case if the officer does not show up they give exstensions some times 2 like in one of my cases. I am not sure what the speed limit is there but i think it is a 65.. but i will check on tuesday i got to go from raleigh to charlotte for court.. drifted a corner... it is stupid.. it will be dismissed.. As for the search the car thing the was wrong of them...my advice since your lic. is in risk is to get a good lawyer.. i got on for $300 on a 3 charge ticket and was pleased with it.. i think i only got 2 points when i probably would have got alot more... And my final bit of my 2 cents advice is to get a V1.. it is great man... I travel from ral. to char. like every week and it comes in handy severaly times.... |

| I am not too too worrieed about losing my license for 30 days...i lost it for a year, 30 days would be a walk in the park. My biggest concern is the charge itself, i want to pleabargain the charge as it stands with a prayer for judgement or get it lowered. If i cant do that im going to fight the searching of my car I think, but only in the event they wont let me pleabargain |

| THEY CANNOT SEARCH YOUR CAR WITHOUT PROBABLE CAUSE AND OR A WARRANT..... you can definatly fight that in court... tell them the officers harrassed you and infringed on you right to privacy |

| I am not sure, but I am heading that way this weekend and I will look. You guys are missing the point about NC laws, probable cause is just saying and officer can't go in your car. Not stopping when he feels...I have been through this, and it doesn't stand up in court. I have actually found that it is easier to just be nice to the cop, play it off like you didn't see him, call him sir, talk to him, tell him your sorry...you know, the run-around. The only officer I gave shit to stuck it to me. They can't go into locked compartments, but they can search the open areas without a warrant. Wes
