I got my rights violated and it was funny!

Ok, so i'm heading out of a food lion parking lot in gloucester, va, to drop off my girl at her car. I take the left out of the lot hard, keep in mind its about midnight, and a cop happened to be sitting in a lot nearby.

So he pulls me over, asks for my license, asks if ive drank, asks if i have anything he should "be concerned with" in my car, I say no, feel free to search it (I dont carry my goods with me on any random drive through the country pig). So he says ok and searches the car, first frisks me for possible "weapons". All you people who think profiling and harassment is just racial is wrong. I'm a 21 yr old tall skinny white guy, look fairly normal, albiet cool .

But anyways, popo numer 2 arrives and were talking while hes searching my car. He asks me if I like BMWs, I say yea theyre very safe and well built. He says kinda like volvo? And I say.. well sorta, but that's volvo's main claim to fame. So we are basicly coolin' it talking about euros when the guy who pulled me over comes back. He starts asking me if im on anything!! I say, I'll do any test you want guys I am sober I was just heading home. So then he says, I saw some sweat on your brow the second I flashed the light on you, you didnt even have time to do anything(well, because there was nothing to do, didnt know sweaty brow is probable cause for full search). Then I lauughed a little and said its really humid out. They smiled, said be careful, and let me off with no ticket.

Strangely, despite having my car searched with no probable cause, I left the experience laughing my ass off on the way home.

And I'm seriously against right violations.. Wtf?

um... there WAS probably cause, your out in the middle of the nite driving like a fool, and you told them they could search your car.... thats all they need

well im not arguing that, i meant if i WANTED to, i couldve said no, you need a warrant or some such crap but i knew i was clean so i let him anyway. I'm citing the audacity of him to do it, and how dumb he acted after finding nadaaa.

i know we have right to say no you cant search my car even if donthave anything but if you say they going to become suspicious and do the search anyways.

do you even understand what rights are?....the right to say no is just that. they have to have probable cause so all of you guys that smoke weed in your cars...if you say no after a stop, they do have the right to do a walk around and if canine indicates narcotics (present or latent) THAT gives them the right to search...not YOU excersizing YOUR rights. If you have the slightest thing wrong then I would advise against riding that fence, I can only speak for myself and what has worked for me...MY car has NEVER been searched as part of any stop I always say NO...I always excersize my right to drag it out for nothing They prey on ignorance of the law just as it is no excuse for breaking it.

my thoughts exactly, if i get pulled over im gonna do my best to make that cop's job as hard as possible, im not here to cooperate with the them, im not gonna answer any incriminating questions and im not gonna let them search my car.

Hey tard cakes, rights are a fallacy, an illusion nowadays.

The one guy was right, if you say no, they'll try to do it anyway, then definantly get suspicious. Now, granted i had drugs or something illegal, your damn right I'd say no and act like a royal ass, spouting off lawyer shit.

PROBABLE CAUSE IS A JOKE IN YOUR TOWN. (just like 911, heheh)

His probable cause IF I said no to the search wouldve been that he "thought i appeared to be under the influence, and then was acting suspicious with resisting a search". THATS ALL HE NEEDS.. he doesnt even need that much. If he "thought I looked under the influence" despite clearly not being under it, thats probable cause for drug search. One little white lie on his part and you can be fucked. Dont think therearent any cops scumbag enough to do it either. I had a cop lie to a judge under oath over a traffic violation! He clearly didn't like me and had it out for me from the get go.. and he got my license taken away, and had me insulted by the judge. Maybe he thought he was right, but if your perception can be that flawed then it scares me to think, or should i say, see more.

And about the dogs, they dont even waste their time with those on random pull over searches around here (intimidating you into allowing a search to appear innocent, thus giving up your imaginary, bypassable, rights), they only use K-9 for big drug bust/investigations, and to find hiding criminals.

I guess the point is yes, according to law we have rights and securities that should be able to protect us. However, when law is enforced by man, those rights and protections can be taken in legal as well as illegal ways. Who cares how they get it, aslong as they do? The law can and does get away with breaking laws to violate your rights when they know they can.

Theres also cops who do recognize the right from search and seizure.

On 3 different occasions my friends have been searched when they specificly said NO when the cop asked. They dont care, they just do it anyway, then lie in court about it.

Its cause they think kids will be too scared to say anything.

Then they wonder why everyone hates them.

You can say no to the cop, in your case you said "feel free to search it" therefore you LET the cop search your car, doesn't matter if he found anything or not. When I got pulled over for reckless driving the cop asked to search my car, I said NO and the cop said ok and just gave me my ticket and left. If you don't want the cop searching your car then don't tell him he can!

any lawyer will tell you, your rights werent violated at all. Your personal perception of your rights, well thats a different story, but one that has no bearing in court. *shrug*
