They cannot give him a dwi because they did not witness the offence. The cops have to se you driving and/or your keys have to be in the ignition. All the cops see is a drunk guy w/ no keys.No proof/no case.
If you ever get stupid and drive drunk and you end up getting in an accident w/ no other people involved............then run like hell. Come back in 15 min when the cops are there.Since you left the scene the cops cannot prove you were drunk. You could have slammed a bottle of Jose in the 15 min you were gone. They have no proof.
