if it starts off in 3rd its slipped into safety or limp home mode and is locked into 3rd gear, this indicates a real problem and it wont correct itself. Many things can cause this mode, solenoid failure, clutch pack issues, pressure issues, throttle position switch, selector switch, electronic issues, etc.

When was the last time you had the transmission serviced? has it been slipping when driving recently? taking longer to change gears? missing gears?

It is quite possible something major has gone wrong, first step imho is to take the car to a transmission specialist, skip the dealer or other workshops. They will have scan tools too so they can pull any trouble codes from the ECU and see if its a sensor fault, or they can drop the pan, inspect and service the trans and let you know if they find anything wrong.

Quite simply, your trans could be shot and it could need rebuilding.

thanks for the reply

the car is always serviced , never had any clue of any issue as it is rarely used. i drove the car for about 20km no prob stopped at the lights and that was it.. bmw says buy new trans , stuff that 9k . besides the starting in third thing . runs perfectly when it gets going

called bmw mel to see if they can help... cause not going pay 9k for a car thats done 20km all up

no, thats a perfectly logical reply from them. There are a whole bunch of things in the transmission that can cause a fault, but are effected by things like heat, load, etc.

Seriously, why do you keep going back to bmw when you keep saying in here you think they are full of shit?

If you want to do something about it, take it to a transmission specialist like i told you, or just sit there and hope its ok only to leave you stuck on the side of the road one day. Your choice.

what model 5er is it? e34 / e39
i test drove a e34 once that was fine under normal driving conditions but the minute you slammed your foot down it dropped into limp mode. not sure what the problem was but rest assured i didnt buy it.
