So, to answer brent6w, yes - the 2000 328Ci is out of warranty since it is not a CPO BMW. But you can always make it a CPO by requesting it be certified at an authorized BMW CPO center and paying for all the necessary repairs to meet the criteria.
I see what you're saying about the warranties, but still, for example, a 98 m3, it's in service date was 11/97 so it should have a warranty for 4 years or 50,000 miles meaning it starts the day it was put in service/sold to the 1st customer up until 11/2001, and then if it's cpo'd it adds an extra two years (6 years/100,000 miles) so if it's cpo'd it would be up until 11/2003, right?

That'll cover everything except for maintenance items as you said such as the oil changes, inspection 1/2, your clutch, brake pads, etc...
