There was a contract to sell the car, that is why Tolofu got money from the buyer, if the title wasn't transfered this contract never took place, so the money needs to be refunded - it doesn't matter if tolofu had to pay impound fees, unless the title was transferred the car was his responsibility... there was a similar case on 'Texas Justice' a few weeks ago, basically:
This girl's aunt sold her a car and never transferred title, the car ended up getting stolen and impounded. As the title was still in the aunt's name she had to pay to get it out of the impound yard and after getting the car back she tried to trade it in on a new car to recoup her impound fees.
The judge ordered the aunt to pay the girl back the purchase price of the car, in addition because the title was in the aunt's name she responsible for the impound fees - this is why there are two parts on the pink slip, if you neglect to send in the release of liability you are... liable for the car, so your storage fees belong to you, if you didn't sell the car you have a refund to give out, there is no 'gee I guess I get to sell it again'...
